The sample submitted, “Achiever Bi-Color Micro Cord Jacket,” style number 9048, is a man’s hip-length jacket with the majority of the shell composed of a woven 100% polyester fabric with a clear acrylic coating, and with color fabric inserts on the upper portion of the front and rear panels of a woven 100% polyester fabric with a clear acrylic coating. The jacket will be imported in sizes S – 3XL. In your letter you indicate that the jacket will also be imported with white color fabric inserts composed of a woven 100% polyester fabric with an acrylic milky coating. The jacket is lined in the body with a mesh 100% polyester fabric and in the sleeves with a woven 100% nylon taffeta fabric. The jacket has a stand-up collar, a full front opening secured by a zipper closure that extends to the top of the collar, long sleeves with partial elastic on the cuffs, two slanted front pockets at the waist, a free-hanging rear yoke that is secured by two hook and loop fasteners at the bottom edge and a drawcord tightening through the bottom hem. The sample is being returned to you as you have requested. Style 9048 is eligible for classification as water resistant. The sample submitted, “Achiever Bi-Color Micro Cord Jacket,” style number 9048, is a man’s hip-length jacket with the majority of the shell composed of a woven 100% polyester fabric with a clear acrylic coating, and with color fabric inserts on the upper portion of the front and rear panels of a woven 100% polyester fabric with a clear acrylic coating. The jacket will be imported in sizes S – 3XL. In your letter you indicate that the jacket will also be imported with white color fabric inserts composed of a woven 100% polyester fabric with an acrylic milky coating. The jacket is lined in the body with a mesh 100% polyester fabric and in the sleeves with a woven 100% nylon taffeta fabric. The duty rate will be 7.1 percent ad valorem. If the jacket does not pass the water resistance test, then the applicable HTS subheading for the garment will be 6201.93.3511, which provides for other men’s anoraks, windbreakers and similar articles of man-made fibers. The duty rate will be 27.7 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
