Dear Mr. Ponthieux: In your letter dated March 27, 2008, you requested a classification ruling. The submitted sample is identified as pattern FAB-005 Blue. It is a dobby woven fabric composed of 100% cotton. It is constructed of yarns of different colors. It contains 16 single yarns per centimeter in the warp and 12 single yarns per centimeter in the filling. This merchandise weighs 390 g/m2 and will be imported in 54 inch widths. Your correspondence indicates that this fabric will be used as upholstery. The applicable subheading for this fabric will be 5209.49.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for woven fabrics of cotton, containing 85 percent or more by weight of cotton, weighing more than 200 g/m2, of yarns of different colors, other fabrics, other. The duty rate will be 8.4%. Duty rates are provided for your convenience and are subject to change.
