Box 1199 Williston, VT 05495 RE: The tariff classification of two women’s capes from China. Dear Ms. Ramsey: In your letter dated March 18, 2008, you requested a classification ruling. Your samples are being returned to you. Styles 63850 and 63852 are woman’s sleeveless capes that are worn over the wearer’s shoulders for warmth. The garments are constructed from 100% polyester knit fabric that is napped on both the inside and outside surfaces. The garments extend from the shoulder to the mid-thigh area. The garments feature a full front opening with two button closures, a hood, two vertical slits for the arms on the front panels, and a hemmed bottom. The applicable subheading for styles 63850 and 63852 will be 6102.30.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers and similar articles, knitted or crocheted, other than those of heading 6104: of man-made fibers: other: other: women’s. The duty rate will be 28.2% ad valorem. Duty rates are provided for your convenience and are subject to change.
