Dear Mr. Maher: In your letter dated March 3, 2008, on behalf of The Children’s Place, you requested a classification ruling. The submitted sample will be returned to you, as requested. Your submitted sample, style F3613M0020 is a girl’s top that is made of 100 percent cotton yarn dyed woven plaid fabric. The bodice has a V-neck inset, one inch wide shoulder straps, an empire waist and a hemmed bottom. The top back edge is cut straight across below the armhole openings and has 3 ¼ inch wide smocking. The tunic style garment also features patch pockets below the waist. The applicable subheading for style F3613M0020 will be 6211.42.0054, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, woman’s or girls’.: of cotton: blouses, shirts and shirt blouses, sleeveless tank styles and similar upper body garments, excluded from heading 6206: with two or more colors in the warp and/or filling.
