Dear Mr. Epstein: In your letter dated March 7, 2008, on behalf of Hydra Sponge Co., Inc., you requested a tariff classification ruling. The blocks are composed of cellular polyurethane plastics, and measure 39 inches by 78 inches by 30 inches. A sample piece cut from the block was provided with your letter. After importation, the blocks will be cut into uniform pieces of various sizes and then individually packaged and sold for use as sponges. The applicable subheading for the polyurethane sponge blocks will be 3921.13.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other plates, sheets, film, foil and strip, of plastics: cellular: of polyurethanes: other. The rate of duty will be 4.2 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
