Dear Ms. De Felice: In your letter dated February 27, 2008 you requested a tariff classification ruling. The sample will be returned to you. The submitted sample, style H3450 is a girl’s polo shirt. The garment is made of finely knit pique fabric that is 95% cotton, 5% spandex. The fabric contains at least 10 stitches per linear centimeter measured in the horizontal and vertical directions. The shirt has a collar, a two button placket opening that fastens right over left, short puff sleeves with rib knit fabric and a hemmed bottom with side slits. The rate of duty will be 19.7 percent ad valorem. Duty rates are provided for your convenience and are subject to change. Girl’s cotton knit blouses and shirts fall within textile category 339.
