One Bowerman Drive Beaverton, Oregon 97005-6453 RE: The tariff classification of a man’s jacket from Thailand Dear Mr. Powers: In your letter dated January 30, 2008, you requested a classification ruling. The sample submitted, style 319266 “FA08 Nike Sphere Pro Full Zip Jacket,” is a man’s hip-length jacket with a shell composed of a bonded fabric consisting of flat knit 100% polyester interlock fabric on the outer surface, a warp knit 100% polyester mesh fabric on the inner surface, and a layer of polyurethane in between. The polyurethane coating is visible through the mesh fabric. The jacket has a stand-up collar, a full front opening secured by a zipper closure that extends to the top of the collar, a reflective strip of fabric on each side of the front zipper opening, long hemmed sleeves, two front pockets with zipper closures at the waist and a drawcord tightening with plastic cord stoppers through the bottom hem. The “Nike” logo is featured on the rear yoke. The sample is being returned to you as you have requested. The duty rate will be 7.1 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
