Dear Mr. Drogalis: In your letter dated January 29, 2008 you requested a classification ruling. Style F08-1032 is a woman’s pajama set constructed from 60 percent cotton and 40 percent polyester jersey knit fabric. The top features a cross over V neckline, hemmed long sleeves, picot trim around the front and back neckline and a hemmed bottom. The pants feature an elasticized waistband and hemmed leg openings. Style F08-1035 is a pair of women’s sleep pants constructed of 100 percent polyester knit fabric. The brushed pants feature an elasticized waistband with a decorative bow in the center and hemmed leg openings. Based on appearance as well as the merchandising information provided, the garments are considered sleepwear and classified in heading 6108. We are returning your samples. The duty rate will be 16% ad valorem. Duty rates are provided for your convenience and are subject to change.
