Dear Mr. Duncan: In your letter dated December 5, 2007, on behalf of UNIQLO, you requested a classification ruling. As requested, the sample will be returned to you. The submitted sample, described by you as pants with an attached skirt is constructed of cotton knit fabric. The legging style pants feature an enclosed elasticized waist and peplum and have a hemmed bottom. The applicable subheading for the pants will be 6104.62.2028, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts, knitted or crocheted: trousers, bib and brace overalls: of cotton: other, trousers and breeches: girls’: other: other. The duty rate will be 14.9 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
