Dear Ms. Ramsey: In your letter dated November 8, 2007, you requested a tariff classification ruling. The submitted sample, item number 63720, is a set of four lobster forks packaged together for retail sale. The two-pronged forks are made of stainless steel and have polyresin handles. Each fork measures 7 ½ inches in length. They are used to extract meat from shell fish. The applicable subheading for the lobster forks will be 8215.99.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for spoons, forks, ladles, skimmers, cake-servers, fish-knives, butter-knives, sugar tongs and similar kitchen or tableware; and base metal parts thereof: other: other: forks: with rubber or plastic handles. The rate of duty will be 0.5¢ each plus 3.2% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
