Dear Ms. Shu: In your letter dated November 14, 2007, you requested a tariff classification ruling. As requested, your sample will be returned. Style 859, “Girls Tricot Mesh Short/Tricot Lined”, is a pair of shorts constructed from 100% polyester, finely knit tricot mesh fabric that is lined with 100% polyester finely knit tricot fabric. Style 859 features an elastic waistband with fabric enclosed adjustable drawstring and hemmed leg openings. The submitted sample is a girls’ size large. The applicable subheading for Style 859 will be 6104.63.2060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ trousers, breeches and shorts (other than swimwear), knitted or crocheted, of synthetic fibers, trousers, breeches and shorts, other, shorts, girls’, other. The rate of duty is 28.2% ad valorem. Style 859 falls within textile category designation 648.
