Product description
You will be importing duvet sets (Ref: 0048). The sets will consist of a duvet cover and two pillow shams. A corner section of the duvet cover and the pillow sham were submitted with your request. The cover and shams will be made from 100 percent cotton woven fabric referred to as “250 TC Wrinkle Free”. The fabrics are not printed and not napped. The edges of the duvet cover and pillow shams have a plain hem. The sham has a single row of top stitching along the edge. In your letter you refer to the duvet cover and pillow shams as a set. The Explanatory Notes, which constitute the official interpretation of the Harmonized Tariff Schedule of the United States at the international level, state in Note (X) to Rule 3 (b) that the term "goods put up in sets for retail sale" means goods which: (a) consist of at least two different articles which are prima facie, classifiable in different headings; (b) consist of products or articles put up together to meet a particular need or carry out a specific activity; (c) are put up in a manner suitable for sale directly to users without repacking. In this case all three criteria are met and the duvet cover and pillow sham qualifies as a set. In our opinion, the duvet cover imparts the essential character of the set.
