Your letter was a follow-up to your original letter dated Sept. 10, 2007, which we returned to you under our file N016843 for more information and a sample. The sample which you have submitted is being returned as requested. You submitted a sample of a product you call the breath buddy. You state that it is for children who are “upper-chest breathers only.” It is constructed of 4”-wide stretch fabric cut and sewn into a harness that is worn over the shoulders and around the chest or abdomen. It adjusts with hook-and-loop fasteners. The applicable subheading for the breathing harness will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change.
