Dear Mr. Ponthieux: In your letter dated October 8, 2007, you requested a classification ruling. The submitted sample is identified as pattern “Dallas 2”. It is composed of 52% filament polyester, 36% filament polypropylene and 12% staple polyester/cotton fibers. The fabric is a jacquard woven with yarns of different colors. It contains 35 single yarns per centimeter in the warp and 17 single yarns per centimeter in the filling. The fabric weighs 118 g/m2 and will be imported in 90-inch widths. Your correspondence indicates that this product will be used as ticking. The applicable subheading for this fabric will be 5407.73.2015, Harmonized Tariff Schedule of the United States (HTSUS), which provides for woven fabrics of synthetic filament yarn, including woven fabrics obtained from materials of heading 5404, other woven fabrics, containing 85% or more by weight of synthetic filaments, of yarns of different colors, other, weighing not more than 170 g/m2. The duty rate will be 8.5%. Duty rates are provided for your convenience and are subject to change.
