Product description
A style number was not provided for the sample submitted. It is a backpack-styled handbag designed and sized to contain the small personal effects commonly carried by a woman on a daily basis. It is constructed with an outer surface of polyvinyl chloride (PVC) plastic sheeting material. The interior has a main compartment with an elastic top opening and a flap with a toggle closure. The exterior has a cotton textile overlay that forms an open-ended pocket. The handbag measures approximately 11” (W) 7” (D) x 8.75” (H). In your letter you mention that a removable sticker with the country of origin will be applied once the shipment arrives in the United States. The marking statute, section 304, Tariff Act of 1930, as amended (19 U.S.C. 1304), provides that, unless excepted, every article of foreign origin (or its container) imported into the U.S. shall be marked in a conspicuous place as legibly, indelibly and permanently as the nature of the article (or its container) will permit, in such a manner as to indicate to the ultimate purchaser in the U.S. the English name of the country of origin of the article prior to its importation. Because there are a variety of acceptable methods of marking, including hang-tags, labels, etc., we suggest you contact your local Customs port for advice on the method that will least detract from the design.
CBP rationale
The applicable subheading for the handbag will be 4202.22.1500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for handbags, whether or not with shoulder strap…with outer surface of sheeting of plastic.
