Dear Ms. Laskavy: In your letter dated July 19, 2007, you requested a tariff classification ruling. You describe the item (SKU #47599) as a stand for a milling/drilling machine. It is constructed of alloy steel and has a locking cabinet and drawer, pre-drilled holes on the top for mounting and has a 2200 lbs weight capacity. The overall dimensions are: 29 1/8”L x 22 7/8”W x 24 5/8” H. The weight of the stand is 133 lbs. You state that the stand is for optional use with a milling/drilling machine (SKU #33686) and is not an integral part of the machine. A review of your website (www.harborfreight.com) confirms that the machine can function sitting on any table the same as it would on the stand. The stand and the milling/drilling machine are sold and advertised separately. The applicable subheading for the stand will be 8466.30.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Parts and accessories suitable for use solely or principally with the machines of headings 8456 and 8465, including work or tool holders, self-opening dieheads, dividing heads and other special attachments for machine tools; tool holders for any type of tool for working in the hand: Dividing heads and other special attachments for machine tools: Other special attachments: Other. The rate of duty will be 8 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
