Your sample is being returned to you. The submitted sample is a drawstring bottle bag constructed from 100% cotton textile material. It measures approximately 7” (W) x 9” (H). It features one storage compartment and a top drawstring closure. It is of a durable construction and suitable for repetitive reuse. It provides storage, protection, portability, and organization to a liquor bottle or other effects. In your ruling request you suggested classification of the bottle bag under 6305.39.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sacks and bags, of a kind used for the packing of goods. However, the bag is of a durable construction and suitable for repetitive reuse. It is akin to the containers and cases that are appropriately classified in 4202, HTSUS. The applicable subheading for the bottle bag will be 4202.92.6091, HTSUS, which provides for other containers and cases, of cotton, other. The duty rate will be 6.3%. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. HTSUS 4202.92.6091 falls within textile category 639.
