Dear Mr. Nelson: In your letter dated July 13, 2007 you requested a classification ruling. Style #N0128212 is a woman’s underwear chemise-styled slip constructed of a lightweight 70% viscose, 25% polyamide and 5% spandex open work knit fabric. The undergarment features padded underwire cups, elasticized adjustable shoulder straps, a flared bottom, and a single hook closure at the garment rear. The bottom of the garment reaches the mid-thigh. Style #N0129484 is a woman’s underwear chemise-styled slip constructed of lightweight 91% polyester and 9% elastane woven stretch satin fabric. The undergarment features padded underwire cups, elasticized adjustable shoulder straps, a flared bottom, and a single hook closure at the garment rear. The bottom of the garment reaches the mid-thigh. The applicable subheading for style N0128212 will be 6108.11.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ slips, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles, knitted or crocheted: slips and petticoats: of man-made fibers, women’s. The duty rate will be 14.9% ad valorem. The applicable subheading for style N0129484 will be 6208.11.0000, HTSUS, which provides for women’s or girls’ singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressings gowns and similar articles: slips and petticoats: of man-made fibers. The duty rate will be 14.9% ad valorem. Duty rates are provided for your convenience and are subject to change.
