Dear Ms. Shu: In your letter dated June 11, 2007, you requested a tariff classification ruling. As requested, your sample will be returned. Style 2438 “Storm Dry-Exel Bi-Color Pebbled Pique Polo” is a men’s shirt constructed from 100% polyester, finely knit fabric that measures 18 stitches per linear centimeter counted in the horizontal direction and 26 stitches per linear centimeter counted in the vertical direction. Style 2438 features a rib knit spread collar; a partial front opening with three button closures; short, hemmed sleeves; a heat seal logo on the right sleeve; and a straight, hemmed bottom with side slits. Style 2438 will be imported in Men’s sizes S - 3XL. The applicable subheading for Style 2438 will be 6105.20.2010, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: men’s or boys’ shirts, of man-made fibers: other: men’s. The duty rate is 32% ad valorem. Style 2438 falls within textile category designation 638. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
