Dear Ms. Trotta: In your letter dated June 12, 2007 you requested a tariff classification ruling. The sample will be returned to you. The submitted sample is called a Soft Headband. The headband is constructed of polyvinyl chloride and textile stretch cord. The polyvinyl chloride is not rigid or semi-rigid and encompasses the head except for a textile stretch cord portion at the back. The essential character is imparted by the polyvinyl chloride, which makes up the bulk of the headband, The applicable subheading for the Soft Headband will be 3926.20.9050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other articles of plastics and articles of other materials of headings 3901 to 3914: Articles of apparel and clothing accessories (including gloves): Other: Other, Other." The rate of duty will be 5% ad valorem. Duty rates are provided for your convenience and are subject to change.
