Dear Mr. Drogalis: In your letter dated May 21, 2007, you requested a tariff classification ruling. The sample will be returned to you. The submitted sample, Style 4704 ladies scrub top is made of woven 60% cotton/40% polyester fabric. The garment is hip length, has a V neck, short sleeves, side slit openings at the bottom and two patch pockets below the waist. The applicable subheading for Style 4704 will be 6211.42.0056, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: Of cotton, blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments, excluded from heading 6206.” The duty rate will be 8.1% ad valorem. Duty rates are provided for your convenience and are subject to change.
