Dear Ms. Stanczak: In your letter dated May 10, 2007, you requested a tariff classification ruling. The submitted sample, Style #HOP530, is a woman’s skirt constructed from 70% acrylic, and 30% polyamide knit fabric. The skirt features an elasticized waistband, an all-over knit open-work design, and a self-finished bottom . We are returning your sample as you requested. The applicable subheading for the women’s skirt, Style HOP530 will be 6104.53.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’s…skirts… knitted or crocheted: Of synthetic fibers. The duty rate will be 16% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The skirt, Style HOP530 falls within textile category 642. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
