Dear Mr. Fragomeli: In your letter dated April 20, 2007, you requested a classification ruling. The sample will be returned. The submitted sample, Item Number 6531307-LJTA Zebra Wrap Skirt, is a woman’s skirt constructed of knit 100% polyester zebra print fabric. The short wrap skirt has an overlap and is secured at the waist by an approximately 2¼ inch wide fabric tie. The garment features a finished fabric tie with an over-size metal grommet, a finished waist and well-made seams. The garment is part of a mix and match Item Number 6531294-LJTA Assortment for a biker costume. The applicable subheading for the Item Number 6531307-LJTA Zebra Wrap Skirt will be 6104.53.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Women’s or girls’…dresses, skirts, divided skirts…knitted or crocheted: Skirts and divided skirts: Of synthetic fibers: Other, Women’s.” The duty rate will be 16 percent ad valorem.
