You have submitted an illustration depicting item NR 91012, which you identified in a telephone conversation as 60 mm diameter rubber gaskets. The gaskets are made of ethylene propylene diene monomer (EPDM) rubber. Although you state that the gaskets will be used around a light fitting in a bathtub, the subject gaskets are not identifiable by their shape or other specific features as a part designed solely or principally for lighting equipment. The applicable subheading for the EPDM gaskets will be 4016.93.5050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of vulcanized rubber other than hard rubber: gaskets, washers and other seals: other, other. The rate of duty will be 2.5 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
