Dear Ms. Hobbs: In your letter dated March 26, 2007, you requested a tariff classification ruling. The submitted sample will be returned to you. The merchandise under consideration is the Backyard Fun Flashlight. This flashlight measures approximately 4.25 inches long by 2.25 inches in diameter at its widest points, requires two “AA” batteries for power, and is constructed of plastic. One end of the flashlight features a single incandescent lamp, clear plastic lens and reflector. The handle incorporates a slide on-off switch and a textured surface to provide a positive grip.
