The subject merchandise is stated to contain 20.1 percent cocoa paste, 21.22 percent sugar, 2.51 percent nonfat dry, 28.0 percent glucose syrup, 21.0 percent water and 6.5 percent sorbitil. You state that the product will be poured over desserts, confectionery and ice cream. It will be shipped to the USA in 1-kilogram bottles packaged for retail sale. The applicable subheading for the “chocolate sauce” will be 1806.90.9090, Harmonized Tariff Schedule of the United States, (HTSUS) which provides for Chocolate and other food preparations containing cocoa: Other: Other: Other: Other: Other. The rate of duty will be 6 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
