Dear Mr. DeBois: In your letter dated January 11, 2007, you requested a tariff classification ruling. Pictures and diagrams were provided with your letter. The Soaking Plug is composed of silicone plastic. It is designed to fit over a bathtub overflow drain by means of suction. The plug prevents water from escaping through the drain holes, allowing the user to fill the water in a bathtub to a higher level. The applicable subheading for the Soaking Plug will be 3923.50.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for stoppers, lids, caps and other closures, of plastics. The rate of duty will be 5.3 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
