Turner Saia Burgess 303 Gregson Drive Cary, NC 27511 RE: The tariff classification of Passenger Cabin Air Temperature Sender from China Dear Mr. Turner: In your letter dated December 28, 2006, you requested a tariff classification ruling. You state: “A classification ruling is requested on Saia Burgess part number: E10087. The product is a Passenger Cabin Air Temperature Sender. This is an electronic temperature sensing unit for the passenger area in an automobile. The printed circuit board thermistor is composed of 2 diodes, 2 capacitors, 3 transistors, and 3 resistors on an epoxy paper laminated board. The unit does not control the temperature but only sends the actual temp back to what every control source is being used in the care.” From your information and description, we understand the E10087 will output an electrical signal whose strength is closely correlated to the current air temperature at its location. We agree that the applicable subheading for the E10087 will be 9025.19.8080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “other” Thermometers, not combined with other instruments. The rate of duty will be 1.8 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
