Dear Mr. Zeitlin: In your letter dated December 4, 2006, you requested a classification ruling for a “shrug.” on behalf of See Saw Couture, Inc. The sample will be returned, as requested. The submitted sample, style C003, is an upper body garment, referred to as a ”shrug,” constructed from 80 percent cotton, 20 percent polyester knit fabric. The shrug covers the shoulders and extends to an area above the bust in front, and covers approximately the upper quarter of the back. The garment has a hood with a drawstring, and long sleeves with rib knit cuffs. The applicable subheading for style C003 will be 6114.20.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other garments, knitted or crocheted: Of cotton: Other: Women’s or girls’. The duty rate will be 10.8% ad valorem. Duty rates are provided for your convenience and are subject to change.
