The pullover and skirt are made of knit velour 100% polyester fabric. The pullover has long sleeves and a finished neckline with ribbon trim and appliqué front. The skirt an elasticized waistband and the hem is trimmed with ribbon. The Cheerleader costume is well made with a finished neckline, styling and embellishments. The Cheerleader Costume consists of two or more garments. Note 13 of Section XI, of the HTSUS, requires that textile garments of different headings be separately classified, thus preventing classification of costumes consisting of two or more garments as sets. If a set cannot exist by application of Note 13, the articles that may be packaged with the garments must also be classified separately.

Dear Ms. Huang: In your letter dated November 28, 2006, on behalf of Sears Holdings Global Sourcing Ltd., you requested a classification ruling. The sample will be returned to you. The submitted sample style G-2651-0, Cheerleader Costume consists of a pullover, skirt and pom poms. The pullover and skirt are made of knit velour 100% polyester fabric.
