Dear Mr. Shea: In your letter dated November 27, 2006, you requested a tariff classification ruling. The merchandise under consideration is a desk, hutch and bookcase combination. You are requesting classification if the components are imported separately. You have submitted a photograph of the desk and hutch combination with your request. All three components, the desk, hutch and bookcase are considered unit furniture. They are separately presented elements of unit furniture that are designed to stand one on the other. Consequently, classification of all three pieces as other wooden furniture is appropriate. The applicable subheading for the desk, hutch and bookcase if imported separately will be 9403.60.8080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other furniture and parts thereof: Other wooden furniture: Other, Other”. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The desk, hutch and bookcase may be subject to antidumping duties.
