Dear Ms. Whitley: In your letter dated October 16, 2006, you requested a tariff classification ruling on behalf of Levi’s Red Tab. As requested, your sample will be returned. Style 83505/83523 is a men’s pullover garment constructed from 100% cotton, jersey knit fabric that measures 30 stitches per 2 centimeters counted in the horizontal direction. The garment is cut and sewn and features a rib knit crew neckline; three quarter length, hemmed, raglan sleeves; and a curved bottom finished with overlock stitching. The applicable subheading for Style 83505/83523 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: other: men's or boys'. The duty rate is 16.5% ad valorem. Duty rates are provided for your convenience and are subject to change.
