Dear Mr. Ponthieux: In your letter dated October 3, 2006 you requested a classification ruling. The submitted sample, designated as style “Passion” E405001A ET4, is a jacquard woven fabric composed of 79% filament polyester and 21% staple rayon. It is characterized by an intricate woven design featuring stylized foliage. Manufactured with yarns of different colors, it is constructed using 150 denier filament polyester yarns in the warp. Weighing 540 g/m2, this product will be imported in 142 centimeter widths. Your correspondence indicates that this fabric will be used as an upholstery fabric. The applicable subheading for the jacquard woven fabric designated as style “Passion” E405001A ET4 will be 5407.93.2090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for woven fabrics of synthetic filament yarn, including woven fabrics obtained from materials of heading 5404, other woven fabrics, of yarns of different color, other, other, other, other. The duty rate will be 12 percent ad valorem. Duty rates are provided for your convenience and are subject to change. At the present time goods produced in China, which fall within textile category 629, are not subject to either quota restraints or visa requirements.
