Dear Mr. Ponthieux: In your letter dated October 3, 2006 you requested a classification ruling. The submitted sample, designated as style “Montrose” H538, is a jacquard woven fabric composed of 64% filament polyester and 36% staple rayon. It is characterized by an intricate woven design featuring a floral motif. Manufactured with yarns of different colors, it is constructed using 200 denier filament polyester yarns in the warp and 20/2 c.c. staple rayon yarns in the filling. Weighing 455 g/m2, this product will be imported in 145 centimeter widths. Your correspondence indicates that this fabric will be used as an upholstery fabric. The applicable subheading for the jacquard woven fabric designated as style “Montrose” H538 will be 5407.93.2090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for woven fabrics of synthetic filament yarn, including woven fabrics obtained from materials of heading 5404, other woven fabrics, of yarns of different color, other, other, other, other.
