Dear Mr. Ponthieux: In your letter dated October 03, 2006 you requested a classification ruling. Laboratory analysis of the submitted sample, designated as style “Marango” E405001B ET5, indicates that it is a dobby woven fabric composed of 69.4% filament polyester and 30.6% staple rayon. It is characterized by a textured surface created by the insertion of novelty yarns in the filling during the weaving process. The fabric has been constructed using yarns of different colors and is said to contain 64 single yarns per centimeter in the warp and 20 single yarns per centimeter in the filling. Weighing 367.1 g/m2, this product will be imported in 142 centimeter widths. Your correspondence indicates that this fabric will be marketed as an upholstery fabric. The duty rate will be 12 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
