Dear Ms. Parker: In your letter dated September 27, 2006, you requested a classification ruling. The provided sample will be returned as per your request. Style 357480 is a woman’s upper body garment, similar to a tank top constructed of 100% cotton rib knit fabric. The garment has shoulder straps that measure more than two but less than 3 inches, a U shaped neckline in front and back, decorative beading and a small oval opening in front below the neckline, and a plan, hemmed bottom. The applicable subheading for style 357480 will be 6109.10.0070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for tank tops and similar garments, knitted or crocheted: Of cotton: Women’s. The rate of duty will be 16.5% ad valorem. Duty rates are provided for your convenience and are subject to change.
