Dear Ms. Navidad: In your letter dated August 21, 2006, requested a classification ruling. As requested the samples will be returned to you. You have submitted three samples. Style 4605 Yummy Mummy is an infant’s costume set. The well-made costume consists of a knit polyester fabric jumpsuit. The item has styling features, a finished neckline, well made waist, seams, arms and ankle edges and a hook and loop strip back closure. The costume also has a lined mummy hood with a hook and loop closure and a battery operated plastic blinking heart with a self clip that is inserted through a slit in the costume. Style 4606 Friendly Skeleton is an infant’s costume set. The well-made costume consists of a knit polyester fleece fabric jumpsuit. The item has styling features, a finished neckline, well made waist, seams, arms and ankle edges and a hook and loop strip back closure. The costume also has a lined skeleton face hood with a hook and loop closure and a battery operated plastic blinking heart with a self clip that is inserted through a slit in the costume. Style 4607 Handsome Devil is an infant’s costume set. The well-made costume consists of a knit polyester fleece fabric jumpsuit. The item has a finished neckline, seams, arms and ankle edges and a hook and loop strip back closure. The costume also has a lined devil horned hood with a hook and loop closure, a detachable devil tail and wings and a battery operated plastic blinking heart with a self clip that is inserted through a slit in the costume. GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the jumpsuits of all styles impart the essential character of the sets.
