Dear Ms. Fox: In your letter dated August 7, 2006, you requested a classification ruling for a woman’s knit garments. The samples will be returned, as requested. Style 440957 is a woman’s tank top constructed from 100 percent cotton rib knit fabric. The garment has a U-shaped neckline in front and back and ½ inch shoulder straps. The neckline, armholes, and bottom all have unfinished edges. The applicable subheading for style 440957 will be 6109.10.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Tank tops… knitted or crocheted: Of cotton: Women’s. The duty rate will be 16.5 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The tank top falls within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
