Dear Mr. Schermann: In your letters dated May 22, 2006, and June 7, 2006, you requested a tariff classification ruling. A description of the product and its packing was submitted with your May letter. Photographs and additional product information was submitted with your June letter. The “Sacher Torte” cake is a round dark chocolate layer cake with a dark chocolate icing. It is available in two sizes, a 4.7-inch diameter cake weighing approximately 1.3 lbs., and a 6.3-inch diameter cake weighing approximately 2.2 lbs. Each cake will be packed individually in a wood box for retail sale.
