Dear Ms. Wanless: In your letter dated May 11, 2006, on behalf of your client The S Group, you requested a classification ruling for a woman’s nightshirt. The submitted sample, Style #W047, is a woman’s nightshirt constructed from 100% cotton knit fabric. The garment extends below the knee and features a crew neckline, ¾” sleeves with rib knit cuffs, a screen-printed design on the back panel below the neckline, slits at both sides, and a hemmed bottom. Based on its appearance, the garment is considered sleepwear and classified in heading 6108. We are returning your sample as you requested. The applicable subheading for Style W047 will be 6108.31.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women's knit pajamas and nightdresses, of cotton, women’s. The rate of duty will be 8.5% ad valorem. Duty rates are provided for your convenience and are subject to change.
