Dear Ms. Harwell: In your letter dated April 24, 2006 you requested a tariff classification ruling. The sample will be returned to you as requested. The submitted sample, style 0980 is a waiter’s shirt made of woven 65% polyester/35% cotton fabric. The long sleeve garment has a mandarin collar and a full front double-breasted button closure that closes left over right. Chapter 62, Note 8 states “Garments of this chapter designed for left over right closure at the front shall be regarded as men’s or boys’ garments, and those designed for right over left closure at the front as women’s or girls’ garments.
