Dear Mr. Conlon: In your letter dated March 14, 2006 you requested a tariff classification ruling. Item #62313205 Figure Candle consists of a pair of 3-dimensional figure-shaped 100% paraffin wax candles (approx. 2”L x 1”W x 3”H), retail packed in a clear acetate box and available in three styles: Snowman, Santa Head and Snowman Head. Your samples are being returned. The applicable subheading for the 3-dimensional figure-shaped wax candles will be 3406.00.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for candles, tapers and the like. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. Candles from China may be subject to anti-dumping duties administered by the U.S. Department of Commerce, Import Administration.
