Dear Ms. Tsiavos: In your letter dated February 22, 2006, you requested a classification ruling. Two samples were submitted for review. Style “8114 Black Lace” is a mitt measuring approximately 12-1/2 inches in length that is constructed of a 90% polyester 10% spandex lace-like fabric. The fingerless item features a thumbhole along the side seam of the hand, two rows of 8 grommets down the glove backside that are laced with a ribbon tie, and a hemmed top and bottom. The mitt will also be available in a 100% polyester knit cut pile fabric as Style “8114 Black Velvet”. The applicable subheading for both styles will be 6116.93.8800, HTSUS, which provides for Gloves, mittens and mitts, knitted or crocheted: other: of synthetic fibers: other: other: without fourchettes. The rate of duty will be 18.6 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
