Your sample will be returned as you have requested. Style RAM-996 is a woman’s knit sleeveless garment featuring a v neckline and a wrap around style of closure. It is fastened on the left panel with two interior buttons; the right panel then wraps over to fasten on the outside of the garment with two more buttons. Underneath the bodice the fabric is gathered for form a skirt like bottom half of the garment that extends to the top of the hips. The knit fabric, constructed of 80% rayon and 20% nylon measures more than 18 stitches per 2 centimeters on the outer surface of the fabric in the direction in which the stitches were formed. This count exceeds the stitch count requirement of statistical note 6 to chapter 61.

You submitted a sample of a women’s knit pullover identified by style number RAM-996. Although you described the garment as a sleeveless tank, it is more appropriately classified in heading 6110. Your sample will be returned as you have requested. Style RAM-996 is a woman’s knit sleeveless garment featuring a v neckline and a wrap around style of closure. It is fastened on the left panel with two interior buttons; the right panel then wraps over to fasten on the outside of the garment with two more buttons. This position is clearly set forth in 19 CFR 177.9(b)(1) which states that a ruling letter is issued on the assumption that all of the information furnished in connection with the ruling request and incorporated therein, either directly, by reference, or by implication, is accurate and complete in every material respect. The merchandise, in its condition as imported into the United States, should conform to the facts and the description as set forth both in the ruling request and in this ruling. In the event that the facts or merchandise are modified in any way, this should be brought to the attention of Customs officials.
