Dear Mr. Pilon: In your letter dated January 26, 2006, you requested a tariff classification ruling on behalf of Medline Industries, Inc. The provided sample is a women’s disposable panty constructed of an open work knitted 80% polyester 20% spandex fabric. The panty features an elasticized waistband and leg openings, side seams, and overlock stitching at the crotch. The panty is used in conjunction with an incontinent soaker pad or liner and is marketed for sale to hospitals and nursing homes. The panty is available in different sizes as styles MBP3202, MBP3703, and MBP3704. The rate of duty will be 8.3 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
