Dear Mr. Conlon: In your letter dated January 20, 2006 you requested a tariff classification ruling. Item #62312116 Floating Candles consists of three 3-dimensional figure-shaped floating wax candles (approx. 2-1/4”D). Item # 62312117 Candle Picks consists of three 3-dimensional figure-shaped wax candles (approx. 1-1/2”D) attached to wooden sticks (5”L). Both items are retail packed in a clear acetate box and available in two assortments: 3 white starfish or 3 red lobsters. Your samples are being returned. The applicable subheading for the wax floating candles and wax candle sticks will be 3406.00.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for candles, tapers and the like. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change.
