Dear Ms. Gilmore: In your letter dated November 28, 2005, you requested a tariff classification ruling on behalf of Calhoun Sportswear. Style JSBCHF, identified as “Hibiscus Jammer Shorts,” is a pair of men’s shorts constructed from 100% cotton, jersey knit fabric. The shorts feature a covered elastic waistband with an outside drawstring; side seam pockets; and hemmed leg openings. The applicable subheading for Style JSBCHF, “Hibiscus Jammer Shorts,” will be 6103.42.1050, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’… trousers, … breeches and shorts, knitted or crocheted: of cotton: shorts: men’s. The rate of duty is 16.1% ad valorem. Duty rates are provided for your convenience and are subject to change.
