NY L87740 September 29, 2005 CLA-2-62:RR:NC:TA:358 L87740 CATEGORY: Classification TARIFF NO.: 6203.43.4040 Mr. Kevin Maher C Air 181 South Franklin Avenue Valley Stream, NY 11581 RE: The tariff classification of boys’ wind shorts from China Dear Mr. Maher: This ruling replaces NY L87149, dated August 30, 2005, on behalf of your client The Children’s Place, which contained errors with regard to fabric content, garment type and style number. A corrected ruling follows. Submitted style T1925G0013 is a pair of boy’s wind shorts. The article has a fully elasticized waistband, slash pockets below the waist and a rear patch pocket. It also has an interior drawstring segment at the front waistband. The outer shell, with the exception of polyester mesh trim fabric at the garment sides and bottom is nylon taslon. The entire garment interior is lined with polyester mesh fabric. The style is a boys’ size 4T. The applicable subheading for style T 1925G0013 will be 6203.43.4040, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’ breeches and shorts, of synthetic fibers, other, shorts, boys’ other. The duty rate is 27.9 percent ad valorem. Boy’s synthetic fiber shorts fall within textile category designation 647.
