The garment is not coated for purposes of HTS heading 6210, nor is it eligible for classification as water resistant as there is no provision for water resistance under the subheading for shirts.

Dear Mr. Hasson: In your letter dated August 16, 2005, you requested a tariff classification ruling on behalf of Milton’s of New York, Inc. Style AB100 is a men’s shirt constructed from 100% polyester, solid color, woven fabric. Style AB100 features a pointed self fabric collar; a full front opening with seven button closures; short, hemmed sleeves; buttoned epaulets on each shoulder; two pleated pockets with flaps and hook and loop closures on the chest; vertical pin tucks on the front and back panels; a reinforced patch on the left chest above the pocket; and a curved, hemmed bottom. The sample shirt is sized 19-19½. The garment is not coated for purposes of HTS heading 6210, nor is it eligible for classification as water resistant as there is no provision for water resistance under the subheading for shirts. The applicable subheading for Style AB100 will be 6205.30.2070 which provides for men’s or boys’ shirts, of man-made fibers, other: other: other: other: men’s. The duty rate is 29.1cents per kg. plus 25.9% ad valorem. Style AB100 falls within textile category designation 640.
