Dear Ms. Harmon: In your letter dated August 22, 2005, you requested a tariff classification ruling. Samples are being returned as requested. The submitted samples are two cylindrical-glass candleholders, item number 329697, which are referred to as the “Glass Tea Light Holders.” This merchandise, which has a red or a pink-colored body, measures approximately 2 ? inches in height by 2 inches across the open-top diameter. Each features an exterior with a spray-painted metallic finish, which is decorated with translucent heart-shaped motifs. The applicable subheading for these decorative glass candleholders will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings, other. The rate of duty will be 6 percent and valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
